(hereinafter referred to as “Landescape” and better identified below), owner and operator of the website https://landescapefurnas.com/ and of the Landescape accommodation is concerned to ensure users of the website, its customers and potential customers not only full compliance with all legal obligations but also total privacy of their personal data.

In processing your personal data we follow the principles of lawfulness, fairness, transparency, purpose limitation, data minimisation, accuracy, storage limitation, integrity and confidentiality and accountability.

Through the present Privacy Policy, we inform you that your personal data will be processed through the website and in person under the following terms:

 

  • PURPOSES AND LEGAL BASIS FOR PROCESSING PERSONAL DATA:

We collect and process your personal data for specific purposes, necessary to manage, monitor and provide our best services, within the scope of our website and Landescape accommodations.

We therefore process your personal data for the following purposes and on the following legal grounds:

  • For the purpose of providing hotel and related services, we process your personal data on the legal basis of our legitimate interest in providing you with a personalized and quality service, the performance of a contract to which the data subject is party and the compliance with the legal obligations to which we are bound, your personal data being essential for the performance of the contract in question.
  • For the purpose of managing bookings, we process your personal data on the legal basis of contractual performance and compliance with legal obligations.
  • If you do not object, we will send you commercial communications related to Landescape’s activity, via e-mail, and we will process your personal data on the legal grounds of our legitimate interest in keeping our customers informed about our services, news and updated information on Landescape’s activity, special offers and campaigns.

If you are not already our customer, in order for us to be able to send you commercial communications related to our activity via e-mail, you must provide us with your consent to do so. This consent may be withdrawn at any time, without this, however, affecting the lawfulness of processing based on consent before its withdrawal. Where necessary, failure to provide your consent will prevent us from sending you commercial communications relating to our activity.

  • For the purpose of responding to queries, clarification requests or complaints, we process your personal data on the legal basis of our legitimate interest in providing you with a personalized and quality service, managing complaints and, where applicable, pursuing the necessary pre-contractual diligence at your request.
  • For the fulfilment of the various legal obligations to which we are bound, we process your personal data on the legal basis of compliance with legal obligations.
  • For invoicing and administrative management, we process your personal data on the legal basis of the performance of a contract to which the data subject is party and to comply with legal obligations to which we are bound.
  • For the use of video surveillance systems, we process your personal data on the legal basis of our legitimate interest in aiming to ensure the safety of people and property in our accommodation.

 

  • PERIODS AND STORAGE OF PERSONAL DATA

We will store your personal data only for the period necessary to pursue the purposes for which they were collected, namely to manage your booking, as well as the accommodation services you have requested. After this period, the data will be deleted.

The period for which we store your personal data may vary however depending on the purpose for which it is processed. We will therefore store your personal data for the following periods:

  • For the purposes associated with the provision of hotel and related services and management of bookings:
    • For the period necessary to ensure full compliance with the contract concluded with you;
    • During the applicable legal time limits;
    • Once the provision of services or the management of the booking is terminated, your data will be stored for six (6) months for the purpose of carrying out satisfaction evaluation questionnaires in that context. The legal basis applicable to such purpose being our legitimate interest in knowing the opinion of our customers and improving our services according to their opinion and requests.
  • For sending commercial communications: until you exercise your right to object or withdraw your consent, whichever is applicable.
  • To respond to queries, clarification requests or complaints: until the personal data are no longer necessary for the fulfilment of these purposes.
  • For the fulfilment of the various legal obligations to which we are bound:
    • During the time necessary to comply with the legal obligations applicable in each case;
    • As for the information contained in/and the respective Accommodation Forms, as well as their duplicates, shall be preserved for a period of one (1) year, counting from the day following the communication of departure, under the terms of the following section;
    • During the applicable legal time limits.
  • For invoicing and administrative management: for a period of ten (10) years.
  • For the use of video surveillance systems: for a period of thirty (30) days after collection, following which they shall be destroyed within 48 hours.

If personal data is used for several purposes that require us to store it for different periods, we will apply the longest period.

 

  • TRANSFER OF PERSONAL DATA

Landescape will not communicate your personal data to third parties, except in compliance with the legal obligations applicable in each case or where necessary for the services to be provided.

For the purposes of controlling foreign citizens in national territory, articles 15 and 16 of Law no. 23/2007, of 4 July, oblige foreign citizens, including nationals of other Member States of the European Union, to personally fill in and sign an Accommodation Form in the model approved by Ministerial Order no. 415/2008, of 11 June. Under the same law, the obligation to ensure the completion and communication of the forms falls on companies operating hotel facilities. Therefore, Landescape is obliged to communicate the respective accommodation form (and all data included therein), through the Accommodation Form Information System (Sistema de Informação de Boletins de Alojamento (SIBA)), within 3 (three) working days, to the SEF or, in localities where there is no SEF, to the Guarda Nacional Republicana (National Republican Guard) or the Polícia de Segurança Pública (Public Security Police), under the terms of Ministerial Order n.º 415/2008, of 11 June.

 

Landescape, in the provision of its services, may contract with third parties to process your personal data on our behalf and in accordance with Landescape’s specific instructions. As is the case with the following entities:

  • We have engaged Cloudbeds (www.cloudbeds.com) to perform the booking service for the Landescape website. Cloudbeds acts under our authority and is instructed by us in writing as to how the data processing is to be carried out. To this end, we have signed a contract with Cloudbeds for the provision of services and a data processing agreement for this purpose;
  • We engage financial and accounting service providers who assist Landescape with invoicing affairs;
  • We contract transport companies to provide transfers as part of Landescape’s services;
  • We hire tour companies that provide tourism-associated services at the Landescape accommodation;
  • We contract a security and surveillance company to protect our tourist accommodation;
  • We engage booking platform services in order to promote our services and facilitate your bookings;

 

Some booking platform services external to Landescape may process your personal data for their own purposes. Consequently, this Privacy Policy does not apply to any data processing carried out by such entities, in particular on third party websites which accept bookings for Landescape.

Where the processing of personal data is carried out through external service providers, in particular those mentioned above, acting as processors, we follow strict criteria in selecting such service providers in order to comply with their data protection obligations and we undertake to sign a data processing agreement with them.

 

 

  • DATA SUBJECT’S RIGHTS 

As a data subject, you have the following rights in relation to the processing of your personal data:

  • Right of access: You have the right to access and/or request a copy of your personal data being processed by us, to obtain information about how we are processing your personal data, as well as to consult your personal data included in Landescape’s archives.
  • Right to rectification: You can rectify your personal data where it is inaccurate, as well as complete those that are incomplete.
  • Right to erasure: You may request the erasure of your personal data when, among other reasons, the personal data is no longer necessary for the purposes for which it was collected or otherwise processed;
  • Right to restriction of processing: You may request the restriction of the processing of your personal data in the following situations: (a) while contesting the accuracy of your personal data; (b) when the processing is unlawful and you have opposed the erasure of the personal data and requested the restriction of their use instead; (c) when we no longer need to process your personal data, but you require it for the establishment, exercise or defence of legal claims; (d) when you have objected to the processing of your personal data for the fulfilment of an obligation of public interest or for the satisfaction of a legitimate interest, as long as these legitimate grounds for the processing override your grounds.
  • Right to data portability: In certain situations, you will be entitled to receive, in a structured, commonly used and machine-readable format, the personal data you have made available to us and those obtained from your relationship with us, as well as to transmit those data to another entity.
  • Right to object: In certain situations you may request that your personal data is no longer processed. We will stop the processing of personal data unless there are legitimate reasons or for the establishment, exercise or defense of legal claims.

You must also indicate the desired right to be exercised. The exercise of your rights is free of charge, except in the case of a manifestly unfounded, excessive or repeated request.
